Product Return 

Food Ventures North America Canada, Inc. dba / Wild Fork Canada has a 100% customer satisfaction guarantee for any product purchased from Wild Fork Canada. If you are unsatisfied with your purchase for any reason, you can request a refund and/or return it to us any time prior to the best before date listed on the product.  You can initiate a return by reaching out to us by chat, by email at care@wildfork.ca or by phone at 1-888-410-FORK (3675). All refunds and/or returns are subject to this  Refund & Return Policy and to approval by Wild Fork Foods.  Wild Fork Foods reserves the right to deny a refund and/or return request in violation of this Refund & Return Policy.  

Proof or verification of your purchase is required for all returns and refunds. If you do not have your receipt, our team will attempt to verify your purchase using the email and/or phone number given at the time of purchase (if any) or by credit card number.  Shipping costs and service and delivery fees are refundable for lost or damaged orders in transit and other carrier related issues.     
 

Shipped Orders 

If your order is returned to us because of an incorrect address provided or refusal of delivery when shipped according to info you provided, we must dispose of the contents and you may not be refunded. In the event an order is delivered late due to an incorrect address or if you are unable to retrieve on the delivery date without prior notification and thawing/damage occurs, you may not be refunded.  Please reach out to us as soon as you identify an issue, so we can review your claim and determine how we may handle the matter, which shall be in our sole discretion. 

Courier Damage:  Unfortunately delays or damage can occur once the package is in transit via the courier due to events that are out of our control (such as inclement weather, accidents, etc.). In the event of damage caused by improper handling or late delivery, we can file a claim and replace the shipment. Please promptly email us at Care@wildfork.ca with a description of the damage. Claim filing is time sensitive and photos of the order in the state it was received may be required in order to show proof of damage. Filing a claim does not guarantee a refund, but we will review your claim and determine how we may handle the matter, which shall be in our sole discretion. 

Non-Courier Issues: In the event of non-courier damage, we ask that you promptly email at Care@wildfork.ca with a description of the damage. Upon request, you may be required to provide evidence (e.g., a photo(s)) of the state in which the order was received. We will review the matter and any reported issues and offer an appropriate resolution which may include replacement of the items in question, credit towards your next order, or a partial/full refund.  

Returns with a receipt will be refunded to the original payment method.

2.          WHAT INFORMATION DO WE COLLECT?                           

Information You Provide Directly to Us

We may collect personal information from directly from you when you interact with us in person, by phone or through mail, register for an account, participate in any interactive features on our Site, subscribe to a newsletter or email list, participate in a survey, contest or promotion, purchase products or services from us, request customer support or otherwise communicate with us. If you represent a business or organization, we may collect information about your business or organization from you, for example, your company name, location, market and GST/PST or other tax information. The types of information we may collect directly from you and store include:

(a) Transactions. Information about the products or services you purchase, for example, your name, address, email, phone number, shipping information, credit card number and purchase and order information or the name, address, email, phone number, or shipping information about other people if you order a gift to be sent directly to the recipient. We do not store full payment card numbers or CVV2 information, and our third-party payment processor processes all transactions.

(b) Account Creation and Use. Certain personal information you provide to us when you register for an account on the Site, for example, your name, address, email, phone number, username and password. We may also collect other information you provide as part of the registration process and the administration and personalization of your user experience on our Site and combine such information with personal information we collect from you.

(c) Your Requests. Personal information provided to us when you sign up to receive promotional materials, request customer support or otherwise choose to provide information through a “contact us” feature, for example, your name, address, email and phone number.

(d) Content You Submit. Content you submit through the Site, for example, your posts and comments or responses to surveys or product reviews.

(e) Career Opportunities. Personal information in connection with your interest in a career opportunity with us.

Information We Collect Automatically

When you access or use the Site, the types of information we may automatically collect about you include:

(f) Usage Information. We may collect information about your usage of and interaction with the Sites and statistics and other information about the online activities of our users on an aggregated (collective) basis. 3.          HOW DO WE USE YOUR INFORMATION?

We may use or share non-personal, non-individual statistical or demographic information in aggregate form with our marketing partners, advertisers or other third parties for research purposes. Such aggregated and de-identified information cannot reasonably be used to identify you and, therefore, no longer constitutes personal information. Such de-identified and/or aggregated information is not subject to this Privacy Policy.

When you submit content (such as a post or comment or public chat) to the Site, any visitors to and users of our Site will be able to see that content. Although some parts of the Site may be private, other parts of the Site are public, and you should take that into consideration before posting to the Site.

4.          WHO WE DISCLOSE INFORMATION TO?               

We may share information about you and aggregated or de-identified information that cannot be reasonably used to identify you as follows or as otherwise described in this Privacy Policy:

5.          SECURITY                          

We are committed to preventing others from unauthorized access to the personal information you provide to us. We maintain administrative, technical and physical safeguards designed to protect personal information against accidental, unlawful or unauthorized access, destruction, loss, alteration, disclosure or use, including, but not limited to:

(a) Updating and testing our technology on a regular basis in order to improve the protection of customer information;

(b) Requiring outside companies and independent contractors to whom we provide customer information for marketing, servicing or processing purposes to restrict the use of such information to only those purposes, and we prohibit independent use of such information; and

(c) Restricting access to your information through the implementation of internal procedures and policies about the proper physical security of workplaces and records.

You play a significant role in protecting your information. After you register on our Site you are responsible for protecting the security of your username and password and for any transaction made using your username and password, even in the event of unauthorized access to your account. Although we will take reasonable security precautions regarding your personal information collected from and stored on the Site, because of the open nature of the Internet, we cannot guarantee that any of your personal information stored on our services or on those of our third parties, or transmitted to or from us, will be free from unauthorized access or disclosure. Accordingly, we disclaim any and all liability and responsibility for any unauthorized access to, disclosure or damage to, interception of, theft, or loss of any data communications and/or personal information. By using the Site, you acknowledge that you understand and agree to assume these risks.

We will retain your information for as long as your account is active or as long as needed to provide you with the services. Additionally, we may keep your information for as long as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

NOTICE TO INTERNATIONAL USERS                                     

The Sites are subject to Canadian law and are intended for users located only in Canada. If you are accessing the Sites from outside of Canada, please be advised that Canadian law may not offer the same privacy protections as the laws of your jurisdiction. By accessing and using the Sites, you consent to the transfer to and processing of your personal information by us.

7.          CHILDREN UNDER 18            

Our Site is not intended for children under 18 years of age. We do not knowingly collect or use personal information from children under 18 without consent from their parent or guardian. You may also follow the opt-out instructions contained in our marketing communications or go to “Communication Preferences” on My Account and uncheck the marketing materials subscription box.

If we receive a request from an individual to access or update personal information we maintain on behalf of a customer or user, we will direct that individual to the relevant customer or user.

Further, where provided by law, you may withdraw any consent you previously provided to us or object at any time on legitimate grounds to the processing of your personal information, and we will apply your preferences going forward.  Subject to applicable law, you may (i) have the right to access certain personal information we maintain about you; (ii) request that we update or correct your personal information; (iii) object to the processing of your personal information or withdraw your prior consent, if applicable; and (iv) ask us to delete your personal information from our database.  To exercise these rights, please contact us as described in the section entitled “How to Contact Us”.   We will process your request in accordance with applicable law and, to help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information.  To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

9.          LINKS TO THIRD PARTY WEBSITES                                     

The Site may contain links to third-party content, services or products by linking to a third-party’s website. If you click on a third-party link, you will be directed to that third-party’s website. We do not exercise control over third-party websites and are not responsible for the privacy practices or the content of any such third-party websites. If you provide any information to parties who provide services to us or to any other sites you encounter on the Internet (even if these sites reflect our branding), different rules and policies may apply to the use or disclosure of any personal information you disclose to them. We encourage you to check the privacy policies of third-party websites before providing your information to them. 10.     THIRD PARTY ANALYTICS SERVICES                                     

We may work with certain third parties to collect, analyze, and use some of the information described above. For example, we may allow third parties to set cookies or use web beacons on the Site or in email communications from us. 12.     BUSINESS TRANSACTIONS      

As we continue to develop our business, we may at some future date become involved in a transaction in which one of our business units may be acquired or considered for acquisition by a third party. 15.     GENERAL                     

One you have entered into a services agreement with us, and in the event of any conflict or inconsistency between the provisions of that agreement and this policy, the provisions of that agreement shall prevail. For avoidance of doubt and to the extent allowed by applicable law, any and all liability under this policy, including limitations thereof, will be governed by the relevant provisions of that agreement. This policy is governed under the laws of the Province of Alberta, Canada, regardless of conflicts of law principles. Any disputes or legal proceedings arising out of or relating to this policy shall as they may pertain to us, at our election, be determined via arbitration (pursuant to the arbitration rules designated by our Site), or in the courts in the Province of Alberta, Canada. If any provision of this policy is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this policy shall remain operative and binding on the parties.


Gift Card Policy

1. INTRODUCTION   

Gift cards may be purchased in-store at any Wild Fork Canada location and may be redeemed to pay for any in-store purchase made at a participating Wild Fork Canada location.  Gift cards have no value until activated at the time of purchase.  By purchasing or using a Wild Fork Canada gift card, you are agreeing to this Gift Card Policy.  Wild Fork Canada reserves the right to change this Gift Card Policy at any time and in its sole discretion.    

2. REDEMPTION   

Gift cards are usable up to current balance on the gift card and may only be used to buy products at any participating Wild Fork Canada store location. Gift cards are non-refundable, not redeemable for cash, and cannot be used to purchase another gift card.    

3. EXPIRATION   

Gift cards do not expire.  Wild Fork Canada does not assess any service fees to purchase, active or use a gift card or to check the gift card balance, or for non-use.   

4. BALANCE INQUIRY   

 You can check your balance in-store or by calling our customer care team at 1-888-410-FORK (3675) or care@wildfork.ca.  Additionally, after making a purchase, whether in-store or online, with a gift card, the remaining balance will be provided to you on your receipt.    

5. RETURNS 

All returns purchased with a gift card will be made in accordance with Wild Fork Canada’s return policy.  Any returns purchased using a gift card will be refunded to the original gift card or, if you no longer have that gift card, it will be refunded to a new gift card.  

6.RISK OF LOSS   

Gift cards will not be replaced or refunded if lost or stolen.  The risk of loss and title for a gift card passes to the purchaser upon sale.    

7. RESALE   

Wild Fork Canada does not permit the resale of gift cards.  Any resale or transfer of a gift card shall be null and void.  

8. COMPLIANCE WITH LAWS   

By purchasing and/or using a gift card, you are certifying that your use and activities in connection with the gift card will comply with this Gift Card Policy and all applicable laws, rules and regulations, and that the gift card will not be used in any manner that is illegal, deceptive, or harmful to consumers or any third party.   

9. WARRANTY   

WILD FORK CANADA MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  IN THE EVENT A CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF THE GIFT CARD.  CERTAIN PROVINCIAL LAWS MAY NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.  IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.     

10. LIMITATION OF LIABILITY   

IN NO EVENT SHALL WILD FORK CANADA BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PURCHASE, USE, OR THE INABILITY TO USE A GIFT CARD, INCLUDING DAMAGES FOR LOST PROFITS, EVEN IF WILD FORK CANADA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.  IN ANY EVENT, THE MAXIMUM LIABILITY OF WILD FORK CANADA TO YOU SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS ($100 CAD) OR THE AMOUNT PAID BY YOU FOR THE GIFT CARD(S) GIVING RISE TO YOUR CLAIM, WHICHEVER IS THE GREATER.    

11. INDEMNIFICATION   

You agree to defend, indemnify and hold harmless Food Ventures North America Canada, Inc. dba / Wild Fork Canada, its direct and indirect parents, subsidiaries and affiliates, and its and their officers, directors, partners, employees and agents, from and against any and all loss, damage, liability, claims, cost or expense (including reasonable attorneys’ fees) arising out of: (a) this Gift Card Policy or your violation of any of its terms; (b) your purchase, use, or misuse of a gift card; and (c) your negligence or willful misconduct.    

12. MISCELLANEOUS   

No waiver by Wild Fork Canada of any term or condition set forth in this Gift Card Policy shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of us to assert a right or provision under this Gift Card Policy shall not constitute a waiver of such right or provision.  If any provision of this Gift Card Policy shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Gift Card Policy and shall not affect the validity and enforceability of any remaining provisions.  This Gift Card Policy constitutes the entire agreement between you and Food Ventures North America Canada, Inc. dba / Wild Fork Canada regarding the purchase and/or use of a Wild Fork Canada gift card and is accepted by you upon your purchase and/or use of such gift card.  By purchasing and/or using a gift card, you represent that you are of legal age to be capable of entering into a binding agreement and that you agree to be bound by this Gift Card Policy.  You may not assign or transfer your rights under this Gift Card Policy, and any attempt to the contrary shall be void and of no effect.   

This Gift Card Policy is governed in all respects by the laws of Ontario and is subject to all applicable federal, provincial, and local laws and regulations.  All issues and questions concerning the construction, validity, interpretation and enforceability of this Gift Card Policy shall be governed by, and construed in accordance with, the laws of Ontario, Canada, without giving effect to the conflict of laws rules thereof, and any matters or proceedings shall take place in the Province of Ontario.  You hereby expressly consent to the sole and exclusive jurisdiction and venue of the courts of the Province of Ontario, for any legal proceeding arising out of or relating to your use and/or purchase of a Wild Fork Canada gift card.  This Gift Card Policy operates to the fullest extent permissible by law.  YOU AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH A GIFT CARD OR THIS GIFT CARD POLICY WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.  ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO A GIFT CARD OR THIS GIFT CARD POLICY MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
